Who Must Have Trust Accounts Audited?

The following conveyancers must have their trust accounts audited if they received or held trust money during the financial year ending 30 June:

Licensed conveyancer (corporation or individual) who received/held trust money
Must have a 'Trust Account' with Unique Identifying Number (UID)
Must notify Fair Trading when opening a trust account (Blue Form)
Nil returns required if no trust money held during the audit period

Important Note

Trust money must be held in a designated trust account at an authorised deposit-taking institution in NSW. The account name must include the words 'Trust Account'.

Qualified Auditors

Trust account audits must be conducted by qualified professionals who meet the following criteria:

Auditors registered with ASIC
Authorised company auditors
Members of CPA Australia (with Public Practice Certificate)
Members of CA ANZ (with Certificate of Public Practice)
Members of IPA (with Professional Practice Certificate)
Qualified under Section 79 of the Conveyancers Licensing Act 2003

Auditor Independence

The auditor must not be a licensee or an employee of the licensee, nor a partner of the licensee. They must be independent and qualified under the Act.

Non-Compliance Consequences

If a trust account audit is not submitted by the due date, the following consequences may apply:

Licensees could be disqualified from holding a licence
Financial penalties for non-compliance
Possible suspension of licence

No Trust Money Held?

If a licensed conveyancer did not receive or hold any trust money during the financial year ended 30 June, they must lodge a declaration stating that fact (Nil Return) within the same deadline.
